Antitrust Infringement of Crop Input Manufacturers and Retailers

McCune Law Group, is investigating bringing a class action lawsuit against the manufacturers of certain crop inputs and their brick-and-mortar retailers for allegedly colluding to price fix across their distribution channels and boycott sales to online retailers who could provide more inexpensive products to growers. In particular, the lawsuit would claim manufacturing groups Bayer, Corteva Inc., Syngenta Corporation, and BASF Corporation allegedly engaged in an illegal conspiracy to raise the prices of crop inputs well beyond what grower yields would support and prevent any competing retailer from selling at more reasonable prices.

For years growers have claimed prices for necessary farming chemicals such as insecticides and fertilizers have skyrocketed from typical brick-and-mortar retailers. This situation created the perfect environment for a more affordable retailer to move into the market. Several e-commerce retailers began selling the same crop inputs for less, tapping into a market of struggling growers eager to trim costs wherever possible. Unfortunately, beginning at least in January of 2016, crop input manufacturers like Bayer and Corteva Inc. manufacturers allegedly agreed to begin restricting supply to these online retailers and raising or fixing prices at brick-and-mortar stores, allowing for manufacturers to control the market for crop inputs.

If you are a grower who, as of January 2016, purchased high-priced crop inputs manufactured by Bayer, Corteva Inc., Syngenta Corporation, or BASF Corporation, you may be eligible to reclaim the cost of inflated goods. Growers Are Losing Money

Farmers are struggling enough as it is with the shift of the American economy. According to Time, 12,000 family farms closed between 2017 and 2018 and overall farm debt is at a staggering $416 billion. This makes it even more unconscionable that multimillion dollar corporations would allegedly conspire to limit competition and hike up prices for their products.

Crop inputs that may have been affected by massively inflated pricing include:
