Antitrust Infringement of Crop Input Manufacturers and Retailers

In particular, the lawsuit would claim manufacturing groups Bayer, Corteva Inc., Syngenta Corporation, and BASF Corporation allegedly engaged in an illegal conspiracy to raise the prices of crop inputs well beyond what grower yields would support and prevent any competing retailer from selling at more reasonable prices.
For years growers have claimed prices for necessary farming chemicals such as insecticides and fertilizers have skyrocketed from typical brick-and-mortar retailers. This situation created the perfect environment for a more affordable retailer to move into the market. Several e-commerce retailers began selling the same crop inputs for less, tapping into a market of struggling growers eager to trim costs wherever possible. Unfortunately, beginning at least in January of 2016, crop input manufacturers like Bayer and Corteva Inc. manufacturers allegedly agreed to begin restricting supply to these online retailers and raising or fixing prices at brick-and-mortar stores, allowing for manufacturers to control the market for crop inputs.
