Dangerous Use of the Peloton® Tread+ Model Treadmill

Peloton® Treadmill

McCune Wright Arevalo, LLP, is investigating the need to bring a class action lawsuit against Peloton® for dangerous product design in their “Tread+” treadmills. Peloton is one of the most prolific exercise equipment companies in the country and has generated over $1 billion in revenue in Q2 of 2021. With so much buzz surrounding Peloton’s success, consumers may expect that their products are top-of-the-line and perfectly safe for use.

Unfortunately, reports reached the United States Consumer Product Safety Commission (UPSC) that the Tread+ model treadmill manufactured by Peloton has allegedly caused serious harm and even death to dozens of children and pets. According to claims submitted to the UPSC, children and pets have become trapped beneath the rear roller of the treadmill, resulting in abrasions, fractures, and one child’s death.

Peloton Issues Delayed Recall

Despite the UPSC issuance of a widespread plea to consumers to stop using the Tread+ and Tread treadmills at once, Peloton reacted poorly to this public outcry, calling the UPSC’s press release “inaccurate and misleading.” Initially, Peloton blamed consumers—claiming that the horrific incidents and injuries resulted from user error.  And even after the tragic death of a child, Peloton callously continued to deny the apparent dangers of its treadmills.

Almost a month after the USPC’s plea, and after facing mounting pressure from consumer product safety advocates, Peloton announced a voluntary recall of all Tread+ machines and admitted their inherently dangerous design.  In connection with the recall, Peloton has told purchasers of the Tread+ customers to cease use of the machines immediately and contact Peloton for a full refund or repairs.
