Pursue a Beneficial Settlement or Verdict with Our Ontario Truck Accident Lawyers
There are over 27,000 commercial motor vehicle accidents in California each year, many of which are underride accidents. Although the trucking industry is regulated by strict state and federal laws, it’s not unusual for a company to cut corners in the name of profit. In fact, many companies pressure their truckers to engage in risky driving behaviors just to meet unreasonable goals and deadlines. Their reckless business choices frequently result in dangerous equipment failures, rollover incidents, and underride accidents. For these reasons and more, commercial motor vehicles are often considered the most dangerous elements on the road.
Commercial motor vehicles can weigh up to 80,000 pounds in California. When a truck accident occurs – particularly an underride crash – there is a 90% chance that the driver and passengers of a smaller vehicle will be killed. The rare survivor is often left with catastrophic injuries that necessitate lifelong medical treatments and professional care services.

What Is an Underride Accident?
An underride accident occurs when a passenger vehicle slides under the trailer of a stalled or slow-moving truck. This type of collision is so dangerous because the car usually gets pinned, crushed, and dragged by the truck’s trailer.
There are three types of underride collisions:
- A front underride collision occurs when a truck strikes and crushes a passenger vehicle from behind.
- A side underride collision happens when a truck is trying to change lanes, complete a U-turn, or turn onto a street. When the passenger vehicle gets trapped under the side of the truck’s trailer, it typically results in devastating crush injuries and fatalities.
- A rear underride collision is when a passenger vehicle slides under the back of a trailer. This type of collision often occurs when a truck is moving slowly on a high-speed road.
Sadly, in most cases, the top of the passenger vehicle is penetrated, flattened, or sheared off, resulting in serious and even fatal harm to any passengers in the car.
Survivors can sustain the following catastrophic injuries during an underride collision:
- Burn injuries
- Internal organ damage
- Neck or spinal cord damage
- Paralysis
- Scarring and disfigurement
- Traumatic brain injuries (TBI)
Pursuing Compensation After an Underride Crash
It can be difficult to single-handedly afford the full extent of your injury-related expenses, particularly in the aftermath of an underride collision. However, you can’t just accept an insurance company’s initial settlement offer. The defendant’s insurance company has one priority: making and saving money. Their claims adjuster will likely try to tempt you into accepting a lowball settlement that doesn’t provide for your projected debts and financial hardships.
At McCune Law Group, we can investigate your case, identify the negligent parties, and negotiate with the defendant’s insurance companies on your behalf. Unlike the insurer, our priority is to help you recover compensation that actively facilitates your physical and financial recovery.
A successful lawsuit can yield the following compensatory damages:
- Existing and projected medical expenses
- Lost income
- Loss of earning potential
- Ongoing professional care fees
- Rehabilitation costs
- Various non-economic damages
