TikTok Facing Lawsuit Over Retaliatory Termination

TikTok Retaliation Termination

At McCune Law Group (MLG), we take pride in standing up for the rights of employees facing unfair treatment in the workplace. Our latest case against TikTok is no exception. We’re bringing forth a lawsuit on behalf of a former Fraud Strategy Expert who alleges he was wrongfully terminated for simply doing his job. This employee was hired to uncover fraudulent activities and fired after he raised the alarm on these and other security violations across the platform.

TikTok’s Alleged Retaliation and Wrongful Termination

The Fraud Strategy Expert was hired by TikTok in May 2023 and tasked with identifying and mitigating fraud on the platform. Within his first six months, he discovered a range of fraudulent activities, including:

  • Romance scams that resulted in over $1,000,000 in fraudulent transactions.
  • Security lapses in TikTok’s tipping functionality
  • Accounts linked to fraudulent activity raising funds for terrorist organizations, including accounts believed to be associated with Hamas
  • Internal processes which made sensitive U.S. user data available to parent company ByteDance’s international employees

Despite these alarming findings, TikTok allegedly downplayed the significance of the reports and instructed the employee to only pursue cases that posed an immediate financial threat to the company itself. The Fraud Strategy Expert was then allegedly met with retaliation after reporting these fraudulent activities. TikTok began diminishing his responsibilities, marginalizing his role, and subjecting him to unwarranted scrutiny. The situation culminated in July 2024 when the Fraud Security Expert employee was placed on a Performance Improvement Plan (PIP), with an ultimatum to accept the plan or face termination. Shortly thereafter, our client was terminated, marking the end of his efforts to expose fraud and security breaches within TikTok.

Fraud Allegedly Tied to Terrorist Organizations Ignored

One of the most serious discoveries our client made involved the identification of several accounts allegedly raising funds for terrorist activities, particularly those linked to Hamas following the October 2023 attacks on Israel. Despite the gravity of these findings, TikTok’s response was limited. In the face of repeated warnings from our client, the platform’s Anti-Money Laundering (AML) team failed to take sufficient action, leaving the application and its users vulnerable to continued criminal exploitation. Whistleblower Protections: Standing Up for Employees’ Rights

The retaliation faced by the Fraud Strategy Expert highlights the importance of whistleblower protections in the workplace. At McCune Law Group, we are dedicated to ensuring that employees who speak out about illegal activities are not punished for their courage. The claims in this case reveal significant lapses in TikTok’s fraud detection processes and an overwhelming failure to uphold ethical responsibilities.
