Bronster Fujichaku Robbins Founding Partne Margery Bronster presents the basis of the firm’s claims against the United States Navy alongside McCune Law Group, Partner and former Marine Corps Major Cory Weck, public health expert Dr. Dora Barilla, and physician Dr. Larry McEvoy.

U.S. Navy Base at Pearl Harbor Allegedly Contaminates Local Water Supply on O’ahu, Hawai’i

Thousands have medical concerns after drinking water containing jet fuel

Bronster Fujichaku Robbins Attorneys at Law (BFR) – a Honolulu-based consumer and commercial litigation firm – is bringing a class action lawsuit over the pollution of an O’ahu, Hawai’i, well that provides drinking water to much of the island. Joint Base Pearl Harbor-Hickam, utilized by the United States Navy and the United States Air Force, is allegedly the source of the contamination. Founding Partner Margery Bronster of BFR brings this complaint alongside Partner and former Marine Corps Major Cory R. Weck of the mainland environmental and consumer law firm, McCune Law Group.

On November 21, 2021, the Red Hill Bulk Fuel Storage Facility on base leeched 14,000 gallons of marine diesel, jet fuel, and water into the nearby Red Hill Well which services at least 93,000 residents. Because of the proximity to the Moanalua-Waimalu aquifer just 100 feet from the leak, locals are concerned petroleum may have contaminated other water sources as well.

Residents Are Experiencing Severe Side Effects

Immediately following the leak, the Navy Region Hawai’i Public Affairs released a statement claiming no pollutants entered the environment and the drinking water remained safe for consumption. However, in the days that followed, hundreds complained of water that smelled like jet fuel and severe illness. The Navy hosted a town hall to address concerns where it revealed the full scope of the contamination. Thousands showed up in-person or tuned in virtually to demand accountability and transparency from the Navy.

Following reports of water contamination from the Red Hill Bulk Fuel Storage Facility, the Hawai’i Department of Health has ordered the Navy immediately stop their activities at the facility. This emergency order came nearly a week after residents were told to avoid drinking the tap water. Governor Ige, Senators Brian Schatz and Mazie K. Hirono, and Representatives Ed Case and Kaiali’I Kahele also issued a joint statement noting, “Test results confirming contamination of drinking water at Joint Base Pearl Harbor-Hickam show that the Navy is not effectively operating the World War II-era facility and protecting the health and safety of the people of Hawaii.” O’ahu locals, including infants, have suffered major medical concerns after ingesting the jet fuel-contaminated water. Complaints include:

  • Mouth and throat sores
  • Nausea
  • Vomiting
  • Diarrhea, especially in infants
  • Stomach cramps
  • Headaches
  • Dizziness

The U.S. Navy at Pearl Harbor Has Been Tasked with Cleanup

The Hawai’i Department of Health has also demanded the Navy perform cleanup of the pollution they caused—a process which has proven to be slow and arduous. Some residents have been displaced from their homes as they await a solution to the jet fuel-contaminated water.

The Navy has a history of fuel leaks and health citations from Red Hill Bulk Fuel Storage Facility. In 2014 and early 2021, the Red Hill facility experienced two other fuel leaks which threatened the environment, and in October 2020, the Red Hill facility was cited multiple times for their lack of maintenance.
