Potential Legal Recourse Over Worsening Sandstorms Caused by Clearway Solar Farm in San Bernardino County

McCune Law Group, (MLG) is investigating the need to bring legal action over the alleged public health and property damage arising from the Clearway solar farm project. Despite the contractors’ alleged promises, residents report the project has stirred up worsening sandstorms in Newberry Springs/Daggett. To discuss the consequences of these sandstorms, MLG is participating in a local town hall for residents to discuss the potential legal issues surrounding the damage to property and health.

The desert surrounding cities in San Bernardino County like Barstow, Newberry Springs, and Daggett contains loose silica sand underneath a crust layer and vegetation that operates to minimize the release of loose silica sand. However, with the development of the Clearway solar farm about 15 miles outside of Barstow, the crust and vegetation was removed in the construction and the fine silica sand beneath was freed to blow in the area’s high winds, causing immense and harmful sandstorms.

Following a short introduction and presentation, Questions and Comments are welcome and encouraged.  As this is for residents, Clearway and Blattner employees are not permitted to attend and will be asked to leave if they attend.

Silica Sandstorms Could be Impacting Residents in the Newberry Springs/Daggett Area

In addition to the property damage that sandstorms cause to homes and vehicles, inhaling silica sand could be harmful. Silica has a crystalline structure. Although it seems incredibly fine while in sand form, it still maintains the jagged edges one may expect of larger crystals like quartz. When inhaled as a sand, the crystal-like exterior can cause severe abrasions to your lungs and trachea, causing the buildup of scar tissue over time. Other symptoms of health concerns to look out for include:

  • Coughing
  • Difficulty Breathing
  • Excessive phlegm
  • Chest pain
  • Fatigue

Attend the town hall meeting if you are concerned you or your family may be inhaling silica sand or if you have experienced property damage.
